1. Who we are and what Callstand is
Callstand ("Callstand", "we", "us") is operated from Mexico by the owner of callstand.com. By creating an account or using the service you agree to these terms. If you use Callstand on behalf of a company, you confirm you are authorized to bind that company.
Callstand is a platform. We provide the rails: accounts, access control, metering, billing, and the technical interface through which an expert's encoded judgment can be consulted. Two kinds of users meet here:
- Providers are independent experts or firms who configure and publish a capability on Callstand and set their own prices.
- Callers (also "buyers" or "clients") are account holders who purchase credits and consult those capabilities, directly or through their own software, agents, and workflows.
Providers are independent. They are not our employees, agents, partners, or contractors, and we do not supervise, direct, or guarantee their work. Callstand is not a party to the professional relationship between a provider and a caller, except as the operator of the platform and, for payment purposes, as merchant of record for credit purchases.
2. Accounts
You must be at least 18 years old and provide an accurate email address. You are responsible for everything that happens under your account, including all activity by your software and any person you allow to use it.
API keys are credentials. Anyone holding your key can spend your credits. Keep keys secret, never commit them to public code, and rotate a key immediately if it may have been exposed. You can rotate a key at any time from your dashboard. We are not responsible for calls made with your key before you rotate it.
We may require email verification and may refuse, suspend, or close accounts as described in section 11.
3. Credits and payment
- Callstand runs on prepaid credits. 1 credit represents $0.01 USD of call value.
- Credit purchases are processed by Stripe. We never receive or store your full card details. The price shown at checkout includes card processing costs.
- Credits are a prepaid balance for using the service. They are not money, not a stored-value instrument, not a deposit, and earn no interest. They are non-transferable between accounts and have no cash value outside the platform.
- Credits do not expire while your account is open and in good standing.
- Prices are stated in USD. You are responsible for any taxes applicable to you, and for any currency conversion or fees charged by your bank or card issuer.
Refunds. Purchased credits are generally non-refundable once bought, because they can be spent immediately. If credits were purchased in error, are entirely unused, and you contact us within 14 days, we will usually refund them at our discretion. If we refund a purchase, we deduct the corresponding credits from your balance; if you have already spent them, we may refund only the unspent portion.
4. Calls, pricing, and refunds on individual calls
- Each capability has a price per call set by its provider, which may differ per verb (for example strategize, draft, and critique may each carry a different price).
- The applicable price is the one in effect at the moment of the call. Providers may change prices; changes apply to future calls only.
- Callers may send an optional max_price with any call. If the current price exceeds it, the call is rejected before any work is performed and nothing is charged.
- Credits are reserved when the call starts. If the call fails with a technical error, the credits are returned to your balance automatically.
- A call that completes and returns an answer is a delivered service and is charged, even if you are unhappy with the answer. If you believe an answer was materially defective, contact us and we will look at it in good faith; remedies are at our discretion and are typically a credit adjustment.
- We apply rate limits and input size limits to keep the service stable. Exceeding them results in a rejected call, not a charge.
5. Terms for providers
Your material and your capability
You keep full ownership of everything you bring to Callstand: your descriptions, examples, guidance, and any material you use to configure your capability ("provider material"). You grant us a non-exclusive, worldwide, royalty-free licence to store, process, and use that material solely to operate your capability and provide the service, including sending the necessary parts of it to our model provider to produce answers to calls. We do not use your material to build or improve capabilities for anyone else, and we do not sell it.
You are responsible for having the rights to everything you upload, and for not including material you are contractually or legally barred from using, such as another client's confidential information, unless you are permitted to do so.
Review and publication
Capabilities and material changes are submitted for review before going live. We may approve, reject, request changes, or remove a capability at any time, including for legal risk, safety, quality, or breach of these terms. Approval is not an endorsement, certification, or verification of your credentials.
Access, distribution, and your customers
You choose who may call your capability. Access is approval-gated by default, and you may switch to open access or revoke a caller's access at any time; revocation is immediate. Your customers are yours: we do not market competing capabilities to your callers, and we do not display competitors on your storefront page.
Earnings and payouts
- For each paid call, model compute cost is deducted first, then our platform fee is applied on a marginal basis to the remainder. The fee schedule is shown in your studio and on our site, and is currently 20% of the first $10, 12% from $10 to $50, and 8% above $50.
- We may change the fee schedule with at least 30 days' notice to active providers. Continuing to offer your capability after that date means you accept the new schedule.
- Earnings accrue as calls are made and are shown in your studio. Payouts are made manually, monthly, in arrears, normally within 15 days of month end, once your accrued balance reaches the minimum payout threshold of $25 USD. Balances below the threshold roll over.
- You are responsible for providing valid payment details and any invoice or tax documentation we reasonably need in order to pay you. You are solely responsible for your own taxes, contributions, and legal or professional obligations arising from your earnings and from the services you provide.
- We may withhold or delay a payout where we reasonably suspect fraud, chargebacks, or a breach of these terms, while we investigate.
- If a caller's purchase is reversed or charged back, we may deduct the corresponding amount from your accrued or future earnings.
Your responsibility for answers
You are responsible for the judgment your capability expresses, in the same way you are responsible for advice you give directly. You must not configure a capability to provide services you are not permitted to provide, or in a regulated field where doing so through software would breach applicable rules.
6. Terms for callers
- Having an account does not entitle you to call any particular capability. Access is granted by each provider.
- You are responsible for what you send. Do not send information you are not allowed to share, and do not send sensitive personal data, health, financial account, or government identification data through calls.
- Answers are provided for your own use in your business. You may use and adapt them freely (see section 9), but you must not resell or redistribute a provider's answers as a standalone product or service, or use them to build a competing capability that imitates that provider.
- You are responsible for reviewing answers before acting on them (see section 8).
7. Acceptable use
You agree not to:
- attempt to extract, reconstruct, or reverse engineer a provider's underlying material, configuration, or system instructions, including by prompt injection or any similar technique;
- use the service to train, fine-tune, distil, or otherwise build a competing model or capability;
- circumvent access controls, rate limits, pricing, or billing, or share your key to give access to accounts that were denied it;
- use the service for anything unlawful, harmful, deceptive, harassing, infringing, or that violates another person's rights or privacy;
- upload malware, probe or attack the platform, or interfere with its operation or with other users;
- misrepresent an answer as human-delivered advice given in real time, or as coming from a provider who did not provide it.
We may investigate suspected violations and take any action we consider appropriate, including suspension, removal, and reporting to authorities.
8. Nature of the answers, and no professional advice
Answers are generated by software configured to reflect an individual expert's judgment. They are produced automatically, without that expert reviewing the specific request or answer. They can be incomplete, out of date, or wrong, and they may not fit your particular circumstances.
Nothing on Callstand is legal, medical, tax, accounting, financial, or other regulated professional advice, and no professional-client relationship is created by making a call. Use professional judgment and human review before acting on an answer, especially where money, safety, legal exposure, or people are involved. Any decision you take, and its consequences, are yours.
The service does not browse the web or access live data unless you provide that information in your request, and it may reason from facts that have changed since it was configured.
9. Intellectual property
- Provider material stays owned by the provider, as described in section 5.
- Inputs you send stay owned by you.
- Answers: as between the parties, the provider assigns to the caller the rights needed to use, adapt, and commercially exploit the answer in the caller's own business, subject to the caller's payment and the restrictions in section 6. Answers may not be unique; similar requests may produce similar answers for other callers.
- The platform, including the Callstand name, site, software, and design, belongs to us. Nothing here grants you a licence to it beyond using the service as intended.
10. Confidentiality of provider material
Callers receive answers, not access. We do not disclose a provider's underlying material, examples, client history, or configuration to callers, and our system is designed to refuse requests aimed at extracting it. No safeguard is perfect, and we do not warrant that determined attempts to extract material will always fail.
11. Availability, suspension, and termination
We aim to keep Callstand available but we do not promise uninterrupted service. We may change, suspend, or discontinue features, and we may perform maintenance, at any time.
You may stop using the service or ask us to close your account at any time. We may suspend or terminate an account for breach of these terms, legal risk, suspected fraud or abuse, or non-payment.
If we terminate your account without cause, we will refund unspent credits and pay any accrued provider earnings due to you. If we terminate for breach or fraud, we may withhold unspent credits and accrued earnings to the extent needed to cover losses, chargebacks, or amounts owed. Sections that by their nature should survive termination do survive it, including sections 7 through 12.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that answers will be accurate, complete, suitable, or that they will produce any particular result.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, or goodwill, however caused.
Our total aggregate liability to you for all claims relating to the service is limited to the greater of (a) the total amounts you paid to Callstand in the three months before the event giving rise to the claim, or (b) $100 USD.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Indemnity. You agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising from your use of the service, your content or material, your breach of these terms, or your violation of any law or third-party right.
13. Changes to these terms
We may update these terms. If a change is material, we will give reasonable notice, such as by email or a notice in the product, before it takes effect. Continuing to use the service after the effective date means you accept the updated terms. If you do not accept them, stop using the service and, where applicable, request a refund of unspent credits.
14. Governing law and contact
These terms are governed by the laws of Mexico, and the courts of Mexico will have jurisdiction, without prejudice to any mandatory consumer protections available to you where you live.
